No-Tolerance Spam Policy

Baseline Data Systems Office Accelerator is a technology platform that uses web-based technology to deliver content once a customer sends that content. While customers may use Office Accelerator to send emails to their recipients, Baseline Data Systems is not the initiating party of the email and is therefore not responsible for the content or the recipient's email address. Each customer is responsible for initiating the sending of emails to their specific email lists. As the sender of the emails, each customer must comply with the terms and conditions of the Baseline Data Systems License Agreement and all applicable anti-spam laws and regulations.

Baseline Data Systems maintains a zero-tolerance spam policy. Clients who send emails that we consider spam may have their accounts suspended or terminated. Customers, ISPs, blacklist administrators, or any recipient who receives an unsolicited email may contact Baseline Data Systems at support@oamobile.com. We also encourage ISPs, mail administrators, and blacklist owners to contact us at any time to share information regarding spam policies or to report suspected unsolicited email activity.

Please send us the complete email in question, including all message headers. If you are the recipient of the email, you should also immediately unsubscribe using the unsubscribe option included in the message. We will take any action we deem appropriate regarding the customer who sent the email in question. The customer may also be required to indemnify Baseline Data Systems against any liabilities, costs, or expenses incurred as a result of such spam activity. Generally, spam is defined as unsolicited mass email sent to individuals with whom you do not have an established business relationship or who have not requested (opted in to) your mailing.

Enforcement of Our Anti-Spam Policy

Baseline Data Systems takes strict measures to enforce this policy, including, but not limited to, the following:

  • Reviewing and monitoring large list imports.
  • Reserving the right to limit the size of list imports into the Office Accelerator system.
  • Utilizing databases of commonly harvested lists to help screen imports.
  • Reviewing emails sent to large numbers of recipients and either approving or rejecting them.
  • Using content-checking technology to identify emails that may contain language commonly associated with unsolicited email.
  • Requiring customers to acknowledge the following statement prior to sending emails: "I certify with my initials that all recipients granted permission to receive this message."
  • Suspending or terminating any customer account used to send spam.
  • Storing a copy of every email sent using Office Accelerator.
  • Maintaining the IP address and subscription date for every new recipient.
  • Including a mandatory unsubscribe/opt-out link in every email, whether text or HTML. This link cannot be removed.

Baseline Data Systems Customers

Each Baseline Data Systems customer must accept the terms of the Baseline Data Systems End User License Agreement (EULA). As part of this agreement, customers must agree to send only permission-based emails. "Permission-based" means that all recipients must have opted in to receive communications from that customer.

A recipient may opt in through a website form, a trade show signup form, another in-person sales venue, or by becoming a current client who has agreed to receive ongoing correspondence from your company.

Baseline Data Systems customers may not use purchased email lists with the Office Accelerator email system, regardless of whether permission was claimed to have been granted or whether the lists are advertised as opt-in.

Baseline Data Systems customers are prohibited from:

  • Emailing anyone who has opted out of your mailing list.
  • Harvesting email addresses from websites or other online sources.
  • Using pre-checked boxes on email signup forms.
  • Using subscription forms that automatically subscribe users to unrelated lists.
  • Sending unrelated offers or information to subscriber lists.
  • Adding email addresses to a list without the subscriber's permission.

Baseline Data Systems customers are permitted to send newsletters and informational content to recipients who have requested to receive those communications from your company.

Transfer of Recipients

Please note that a recipient subscribing to one of your mailing lists does not grant permission for you to transfer that recipient to another list or to send unrelated content, even if it is sent through the same mailing system.

False Positive Spam Complaints

We understand that recipients who subscribed to your communications may occasionally forget that they subscribed. For this reason, we maintain the IP address and subscription date for all new recipients.

If we receive a complaint from a recipient for whom we have a valid subscription record, and the email content matches the content to which the recipient subscribed, we will notify the recipient of the subscription date and originating computer and provide a link to unsubscribe from your mailing list.

In these situations, we will also notify you of the complaint, explain the action taken, review your website, and may recommend changes to the signup notifications or subscription descriptions presented to your subscribers.

If a complaining recipient was imported into the system and did not subscribe through your website, no IP record or subscription date may be available. In such cases, we will investigate the complaint and review the email in question. If it appears that unsolicited commercial email may have been sent, we will immediately disable email sending for the account and contact you by email and/or phone.

Once we are able to verify that the recipient was in fact an opt-in subscriber, we will remove the sending restriction from the account.
